MPD cites man on day care property

A man was cited for criminal trespassing Wednesday morning after police were called to a Northeast Midland day care where a parent notified them of a suspicious individual in the parking lot.
According to officials, the woman who reported the incident said she recognized the man from the previous day when he was performing lewd acts inside his vehicle.
But the Midland Police Department was first notified of the alleged activity on Wednesday, spokeswoman Tina Jauz said.
The Hispanic man, whose name is not being released, was found alone in a gold Ford Expedition when police arrived on the scene around 8 a.m. Because he was not exposed and was fully clothed when officers arrived, police said there was not enough evidence to make an arrest.
The incident circulated in an e-mail around town warning parents to be alert and cautious of the individual.
Authorities said this was the first report taken, and the man was given a ticket for criminal trespassing, which officials with the city of Midland municipal court said is a pending class C misdemeanor.
Because he is not charged with a felony, the Reporter-Telegram is omitting his name from this report.
